The so-called “dioxin case”

In the much publicized so-called dioxin case concerning the waste incinerator of Gilly-sur-Isère, associations of ecologists and people living near the incinerator summoned the former mayor of Albertville and former president of the intercommunal syndicate which owned the incinerator as well as the then-incumbent Prefect to appear before the Criminal Court of Albertville, despite the fact that the claim brought against them for endangering other people’s life had been fully and definitively dismissed by the Investigating Chamber of the Court of Appeals of Chambery on September 9, 2009.

On May 23, 2011, the Criminal Court held that the claim of the associations was inadmissible because a person who benefited from a full dismissal may not be judged twice for the same facts, whatever the nature of the charges retained.

Like during the investigations and proceedings before the Court of Appeals of Chambery of Chambery, the former mayor of Albertville and former president of the intercommunal syndicate was represented by Jean-Luc Soulier.
